By submitting an appointment request, accessing or using our website and related software ("Website"), confirming your appointment, or utilizing any of our services, you ("you" or "your") agree to the following Terms of Service:
OUR RESPONSIBILITIES
Mobile Notary & Fingerprinting, LLC, including its parent companies, subsidiaries, authorized representatives, and assigns, ("MN&F", "We", "Us, and "Our") is a third-party scheduling agency for notary and fingerprinting services. MN&F will vet, dispatch, and facilitate the services of professional and reliable notaries and fingerprinting technicians ("Notary"), provide logistical and administrative support to help successfully complete your assignment, and accept, collect, and, under specific circumstances and in our sole discretion, refund or reimburse payment for services rendered to you.
MN&F does not directly provide notary or fingerprinting services. Your Notary is an independent contractor and is not an employee, affiliate, or authorized representative of MN&F. As such, the Notary is not authorized to speak for or contractually bind MN&F in any way.
Notaries are appointed and commissioned by the state in which they reside or operate. When performing a notarial act, they are personally acting in an official capacity. That being the case, your Notary is solely responsible for any error or omission. MN&F is not liable, and assumes no legal responsibility, for said errors or omissions; you agree to hold MN&F harmless.
USE OF OUR WEBSITE
You are authorized to use our Website for the purpose of accessing information about and electronically requesting our services, and, with the functionality we provide, tracking the assignments you request. Permission to use the Website is not assignable or transferable and can be revoked at any time at our sole discretion and without prior notice. Said permission does not grant you any rights of ownership; we reserve all rights to the Website in its entirety. You may not copy, alter, modify, embed, incorporate, or repurpose the Website without prior written authorization, and you may not use it for any illegal or unauthorized acts or purposes.
PAYMENT AND ADDITIONAL FEES
For your safety and the Notary's, WE DO NOT ACCEPT CASH PAYMENTS FOR OUR SERVICES. Payments can be conveniently made by credit or debit card. You may also prepay the full amount due via electronic invoice. "Mobile Notary Systems, LLC" will appear on your payment statement.
YOUR NOTARY CANNOT PROCESS YOUR PAYMENT OR ACCEPT CASH FOR YOUR SERVICES. Please do not, under any circumstances, provide payment information to the Notary.
Because we incur a cost to dispatch your Notary, you must either provide payment information or prepay your electronic invoice for the full amount due PRIOR to your appointment. If the cost for the services you actually receive exceeds the amount you prepaid, you agree that you are responsible, and that the outstanding balance is due and must be paid at the time of service.
You agree that you are financially responsible for additional or incidental expenses incurred by MN&F or your Notary, including, but not limited to, parking, travel to additional locations required to complete your job, and printing of additional documents necessary to complete your job.
Payments declined due to insufficient funds are subject to a $25 collection fee.
If the Notary is required to wait longer than 15 minutes, a Wait Fee will be thereafter assessed at the rate of $1 per minute. This fee may be waived at MN&F's sole discretion.
FAILURE TO PAY
In the event that you fail to pay for services rendered to you, you agree to be financially responsible for any and all legal and attorney fees incurred by MN&F to collect the amount you owe. Except in states where prohibited, the Notary may also exercise the right to contact the state or federal authority under whose jurisdiction your document is governed and revoke their notarization or certification. You assume all legal or financial consequences suffered by you and/or your client resulting from such action.
CANCELLATION
Appointments must be cancelled by phone or email to our office no less than twenty (20) minutes prior to the scheduled appointment time. If not, Dispatch and related fees will apply.
SMS/Text Messages:
Description
Our SMS program provides text messages for appointment reminders, events, receipts, customer service, and occasionally promotional messages when you opt in. Message frequency varies depending on your interaction with our services.
Opting Out
You can cancel the SMS service at any time. Simply text "STOP" to the shortcode (number provided). Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, or text "START" to resume receiving messages.

Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Message and Data Rates
Message and data rates may apply for messages sent to you from us and from you to us. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
